IE OSC Online Safety Code, Part B s 12 (para 12.10) - Age assurance for adult-only video content
Where the terms do not preclude adult-only video content, implement effective age assurance (not self-declaration alone) so children cannot normally see it, and keep the age data out of commercial use
Where this comes from
Provision: Online Safety Code, Part B s 12 (para 12.10) - Age assurance for adult-only video content; Part A s 10 (paras 10.6(f), 10.8, 10.9); s 17 (para 17.2)
Instrument: Ireland Online Safety Code
Citation: Coimisiun na Mean Online Safety Code (2024), Part B s 12, paras 12.10, 12.2(a), 12.3; s 11 (adult-only video content; age assurance measure); Part A s 10, paras 10.6(f) with footnote 3, 10.8, 10.9; s 17, para 17.2; s 2 (scope)
Text version: Coimisiun na Mean Online Safety Code, adopted 10 October 2024 under Section 139K of the Broadcasting Act 2009 as amended by the Online Safety and Media Regulation Act 2022; Part A applied from 19 November 2024 and Part B from 21 July 2025 (dates determined by the Commission; cnam.ie); retrieved from cnam.ie on 2026-09-21.

- Age Gate with Self-DeclarationCovers part of it
Simple age verification using date of birth entry with validation and session storage.
Sample acceptance criteria Landfall generates for this obligation:
- A designated video-sharing platform service provider (a named service designated by the Commission under the Act and listed on its published register, Code ss 2.2-2.3) whose terms and conditions do not preclude the uploading or sharing of adult-only video content (pornography; realistic gross or gratuitous violence or cruelty, s 11) MUST implement effective age assurance measures to ensure that adult-only video content cannot normally be seen by children; an age assurance measure based solely on self-declaration of age is not an effective measure (para 12.10; Part A para 10.6(f) with footnote 3). Children's personal data collected or generated for age verification MUST NOT be processed for commercial purposes such as direct marketing, profiling and behaviourally targeted advertising (paras 10.9, 17.2). The alternative is to preclude adult-only content in the terms (para 12.2(a)); a service or dissociable section devoted to adult-only content MUST preclude its use by children (para 12.3). The most harmful content shall be subject to the strictest measures (para 10.8).
- First establish the Code’s service scope and adult-only-content terms. Assess age-assurance effectiveness and privacy proportionality. Other appropriate age-verification measures under Part A require separate assessment; do not generalize this specific rule to every online service. Self-declaration alone does not satisfy para 12.10, nor Part A (footnote 3 to para 10.6). Do not use age assurance data for direct marketing, profiling or behaviourally targeted advertising (paras 10.9, 17.2).
- Record the assessed scope, evidence and unresolved questions; completing this task is not a legal compliance determination.

Source-scoped applicability and implementation assessment
Record Irish jurisdiction/designation and adult-only-content terms first. For section 12.10 scope, assess age-assurance effectiveness and privacy. No account-registration or under-16 restriction; Part A measures need separate assessment.
